Agreement of Sale

An agreement of sale between Tap & Cork Pty Ltd and a customer is only valid once payment has been made and the company receives proof of payment. Up until this point all goods remain the property of Tap & Cork Pty Ltd.

Terms and Conditions (t’s&c’s)

These Terms and Conditions (T’s & C’s) govern the use of the Tap & Cork website by you (the User) located at and your relationship with Tap & Cork Pty Ltd (the Provider). The Tap & Cork Website (the Website) is provided to the User for personal use and is subject to these T’s & C’s. By accessing and using the Website, the User agrees to be bound by the T’s & C’s in accordance with South African law. In order to utilize the services offered by the Provider, you are required to register on the website. The User may not access, display, use, download, and/or otherwise copy or distribute any content obtained on the Website for any purposes without the consent of the Provider. By accessing and using the Website, the User acknowledges and agrees to not make use of the Website for any purpose that is unlawful or prohibited by these T’s & C’s.

Electronic Communications

By using the Website or communicating with the Provider by electronic means, the User consents that all notices, agreements, disclosures or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.


The Website markets, sells and distributes various food and food related products online as a service to the User. The use of any product bought from the Website is at the User’s risk. The User indemnifies the Provider against any loss, injury or damages which may be a result of using the products sold on the website. This does not apply to the Provider’s liability for personal injury or death caused by its negligence.

Delivery Policy

This is subject to the availability of stock from the Provider’s suppliers and receipt of payment. Requests will be processed within 2 to 5 days and ceded to a courier company for collection/delivery. For very remote areas not serviced by standard couriers The Provider will deliver via Post Office, or to the nearest town to the User that is accessible by Berco Express within their normal routes. In these circumstances the Provider will be in contact with the User to arrange an alternative address. Successful dispatch of an order will be confirmed by way of electronic communication to the User. The Provider will ensure that all goods are packaged in a satisfactory manner and in full working order ready for collection by the courier company. The Provider will not be held liable for the condition of products arriving at the User’s chosen delivery address. Any dissatisfaction regarding the quality of goods purchased by customers from the Website should be directed to or on our contact page.

Export Restriction

Offers on the website are available to South African clients and deliveries are currently only made in South Africa. Deliveries outside South Africa are available under special arrangement prior to placing an order on the website. Please contact us to make any special arrangements. Return and Refunds Policy The products offered on the Website are subject to stock availability from the Provider’s suppliers. The Provider reserves the right to cancel any order for which payment has been received. In the event of limited stock or if the quality of goods ordered by the User does not meet the Provider’s criteria, the Provider will make a full refund the User. Cancellation of orders placed on the website will be refunded to the User after the deduction of a 15% charge for administration costs. Products purchased on the website are non-returnable unless the product is faulty or an incorrect product which has been delivered by the Provider. The Provider will exchange goods on condition that the User returns the product within 5 days of taking receipt. The Provider will make a reasonable effort to replace the product, but if this is not possible, the User will be refunded the purchase price and delivery cost upon the Provider’s receipt of the returned goods. Refunds for products purchased under a promotional offer will be based on the terms of the promotional price. If you receive the wrong product you must contact Faithful to Nature within one working day. We will check our system to see whether a miss pick has occurred. If there was a miss pick we will arrange to swap the 'wrong' product for the one actually ordered on our account.

Payment Options

Payment may be made via Visa or Master Card credit cards, by electronic bank transfer into the Provider’s bank account, or the Payfast website, the details of which will be provided on request. Orders received by the Provider will be processed upon receipt of proof of payment. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

Customer Privacy Policy

All private information required for enlisting the services of the Provider, will be kept in strict confidence by the Provider and will not be sold or made known to any third parties. Only information essential to service delivery will be made known to third parties delivering the goods. The Provider has taken reasonable precautions to secure the credit card payment option for services rendered on the website. When personal information such as a credit card number is transmitted to other web sites, it is protected through the use of encryption. The User is responsible for the secure storage of password details as used on the Website. The User will be held accountable for all activity submitted under this password and account. The Provider cannot be held responsible for security breaches to a User’s account as a result of inadequate virus protection or malicious software installed on the User’s device. If the User suspects that someone else has accessed his/her account, the Provider should be notified immediately. The Provider reserves the right to change the User’s password or suspend the User’s account if the Provider has reason to believe that a breach of security has taken place.

Casual Surfing Privacy

The User may visit the website without providing any personal information. No distinguishing information other than the IP address of the User’s device will be collected. The Provider uses this information to determine usage statistics of the Website. There is no obligation on the Provider to protect this information, and it may copy, distribute or otherwise use such information without limitation. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000

Credit card acquiring and security

Credit card transactions will be acquired for the Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Customer details will be stored by the Provider separately from card

Promotional Vouchers

Promotional Vouchers may only be used on the Website and are subject to the T’s & C’s as well as any specific conditions noted on issue to the User. Each Promotional Voucher issued is only valid for one transaction per customer and is non-transferable. Promotional Vouchers cannot be exchanged for cash or used to purchase gift-vouchers. Promotional Vouchers may not be distributed, reproduced or published without the prior written permission of the Provider. Promotional Vouchers remain the property of the Provider and the Provider reserves the right to withdraw or cancel a Promotional Voucher at any time.


It is the Provider’s responsibility to deal with the sale of goods and services provided on the Website, customer service and support, dispute resolution and the delivery of goods ordered. The information contained on the Website is not intended to be a substitute for professional medical advice and is published for educational purposes only. It remains the obligation of the User to seek the advice of his physician or other qualified health care professional about any questions s/he may have regarding nutritional requirements in his/her diet.

Gift Vouchers

Tap & Cork Gift Vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed or used without permission. Vouchers cannot be resold to- or exchanged with a third party. You cannot use a Voucher to purchase another Voucher. Vouchers can only be redeemed online.

Updating of the Terms and Conditions

The Provider reserves the right to modify or change these T’s & C’s from time to time. Changes to these T’s & C’s will become effective upon such modifications being posted to the Website. Continued use of the Website by the User following any updates will be considered notice of the User’s acceptance to be bound by the updated T’s & C’s. It is the User’s obligation to periodically check these T’s & C’s for updates.

Copyright and Intellectual Property Rights

Information displayed on the Website is published by the Provider, its affiliates and third party owners, and includes but is not limited to Literary and Artistic Works (the content). All such proprietary works are copyright of the Provider, its affiliates and third party owners of such rights (the owners). All rights to the content are reserved and retained by the owners. The content provided on the Website is protected by South African and International copyright laws. The Provider and owners reserve the right to make changes to the content, products or services offered on the Website at any time and without notice. No Copyright, Trademark, or Intellectual Property Rights licence is granted to the User except as specified in these T’s & C’s.

Limited License to General Users

The Provider grants the User a limited, non-exclusive, non-transferable right to access, display, use, download and otherwise copy current content for personal informative and non-commercial purposes only. The website and content may not be duplicated, reproduced, resold, visited or exploited for any commercial purpose without the express prior written consent of the Provider. The license does not permit any derivative use of the Website or content for the benefit of another merchant. The Provider does not offer products or services to minors. If the User is under the age of 18, he may not accept or act upon any offers published on the Website. The Provider, owners and affiliates reserve the right to cancel orders, refuse service, terminate accounts and remove or edit content at their sole discretion.

Limitation of Liability

The Website, content and related services are provided on an “as is” basis. Content may include inaccuracies or typographical errors, and the Provider makes no guarantee as to the availability or accuracy of the content. All offers on the Website are subject to availability. Choice of Law

The Website is operated and administered by the Provider from its offices in South Africa. Accessing the website from territories where such content is illegal is prohibited. If the User accesses the Website from locations outside of South Africa, that User is responsible for compliance with all local laws. The User may not use the Website in violation of South African export laws and regulations. These T’s & C’s shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Magistrates’ Court in the event of any dispute. If any of the provisions of these T’s & C’s are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these T’s & C’s, and the remainder of these T’s & C’s shall continue to be of full force and effect. These T’s & C’s constitute the entire agreement between the Provider and the User with regard to the use of the content and the Website and shall be governed by and construed in accordance with the laws of South Africa. Any disputes will be decided only by South African courts.
